Who pays the broker?

This question depends primarily on whether the property is for rent or for sale. In the case of a rental property, the “Bestellerprinzip” regulates who pays the broker, while different rules apply to a property for sale. In the case of properties for sale, the client not only negotiates the amount of the commission with the broker, but also determines who has to pay the commission. Depending on the federal state, there are restrictions for the client. In general, however, the client can stipulate that the buyer or seller must pay the entire commission or that the payment be split between the two.

Brokerage principle – From when do I pay?

The “Bestellerprinzip” is applied to rental properties and determines who has to pay the broker’s commission. It states that the person who has commissioned the broker must also pay him.
